You must be at least 18 years old to use Occazion. By using the Services, you represent that you have the legal authority to enter into these Terms.

2. Account Registration

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and complete information
• Keep your login credentials secure
• Be responsible for all activity under your account

Occazion is not responsible for unauthorized access resulting from your failure to secure your credentials.

3. Use of the Services

You may use Occazion only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Services for spam, harassment, or abusive messaging
• Send invitations or messages without proper consent
• Upload unlawful, harmful, misleading, or infringing content
• Attempt to access systems or data without authorization
• Interfere with or disrupt the platform or infrastructure

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Invitations & Guest Communications

Occazion allows hosts to send digital invitations and collect RSVPs.

You acknowledge that:

• You are responsible for ensuring you have permission to contact your guests
• Guests may opt out of communications at any time
• Guest responses are tied only to the relevant event
• Occazion is not responsible for disputes between hosts and guests

4A. SMS Program Terms

Program name: Occazion SMS Invitations

Description: Receive event invitations, RSVP links, confirmations, reminders, and related event updates from hosts using the Occazion platform.

Hosts are required to have prior express permission from recipients before providing a phone number to Occazion.

Message frequency varies depending on the event and host activity.

Message and data rates may apply.

Messages are limited to event-related content only. Consent to receive SMS is not a condition of purchase.

For support, contact support@occzn.com or reply HELP.

You may opt out at any time by replying STOP. After you send STOP, you will receive a confirmation message and will no longer receive SMS notifications related to that event.

5. Plans, Pricing & Payments

Some features require payment.

Key terms:

• Pricing is based on guest count and applies to new events only
• Existing events retain their original limits
• Payments are processed by third-party providers (e.g., Stripe)
• Fees are non-refundable unless required by law or stated otherwise
• Occazion may change pricing or plans at any time, with changes applying only to future purchases

6. Free & Paid Features

Occazion may offer free features or trial functionality. We reserve the right to modify or discontinue any feature at any time.

7. Intellectual Property

All content, designs, templates, logos, and software provided by Occazion are owned by or licensed to Occazion and are protected by intellectual property laws.

You may not:

• Copy, modify, resell, or distribute our templates or platform
• Use our branding without permission

You retain ownership of the content you create, but grant Occazion a limited license to host and display it for providing the Services.

8. User Content

You are solely responsible for content you submit or share through the Services.

You represent that your content:

• Does not violate laws or third-party rights
• Does not contain malicious or harmful material

Occazion may remove content that violates these Terms.

9. Service Availability

Occazion strives for reliability but does not guarantee uninterrupted service.

We may:

• Perform maintenance
• Experience outages or delays
• Modify or discontinue features

Occazion is not liable for downtime or data loss except as required by law.

10. Data & Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use data.

By using Occazion, you consent to data processing as described in the Privacy Policy.

11. Third-Party Services

Occazion may integrate or link to third-party services (e.g., payment processors, email/SMS providers).

We are not responsible for third-party services, content, or policies. Your use of those services is subject to their own terms.

12. Termination

We may suspend or terminate your access to the Services:

• For violations of these Terms
• For suspected fraud or abuse
• To comply with legal obligations

You may stop using the Services at any time.

13. Disclaimer of Warranties

The Services are provided "as is" and "as available."

Occazion disclaims all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement

We do not guarantee specific outcomes or results from using the Services.

14. Limitation of Liability

To the maximum extent permitted by law:

• Occazion is not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid to Occazion in the past 12 months

15. Indemnification

You agree to indemnify and hold harmless Occazion from claims arising from:

• Your use of the Services
• Your content
• Your violation of these Terms or applicable laws

16. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.

17. Changes to These Terms

We may update these Terms from time to time. Changes will be posted with an updated "Last updated" date.

Continued use of the Services constitutes acceptance of the updated Terms.
